Clean Energy Implementation Plans (CEIP) and Compliance with the Clean Energy Transportation Act (CETA) Rulemaking, UE-191023

On January 15, 2020, the commission filed with the Code Reviser a Preproprosal Statement of Inquiry (CR-101), initiating a rulemaking to promulgate new rules to implement certain sections of the Clean Energy Transformation Act (CETA), centered on the implementation of Chapter 19.405 RCW and revisions to Chapter 80.28 RCW. Also on January 15, 2020, the commission issued a notice to stakeholders of an opportunity to answer questions on the direction of the rulemaking and the issues under consideration. Comments are due by 5 p.m. on February 28, 2020.

On January 16, 2020, the commission issued a notice of a workshop to be held jointly with the Department of Commerce on the subject of Equity and Planning in this and other current commission rulemakings. The workshop will be held at 8:30 a.m. on February 5, 2020, in the commission's Richard Hemstad Hearing Room, 621 Woodland Square Loop SE, Lacey, Washington.

On February 19, 2020, the commission issued a notice of workshop to be held jointly with the Department of Commerce on the subject of Incremental Cost. The workshop will be held at 9 a.m. on March 17, 2020. The workshop has been rescheduled as a webinar-only workshop. Parties may participate by telephone, but participation by computer will make it easier to facilitate the discussion. The commission will not host an in-person meeting space.

On April 7, 2020, the Commission issued a notice of workshop to be held on the subject of public participation. The workshop will be held on May 5, 2020, at 9 a.m. This will be an online-only workshop. Parties may participate by telephone or via the Skype for Business app (Instructions).The commission will not host an in-person meeting space.

On May 4, 2020, the commission issued a notice of workshop on equity provisions in all three of the current CETA-related rulemakings. The workshop will be held at 1 p.m. on May 22, 2020. This will be an online-only workshop. Parties may participate by telephone or via the Skype for Business app (Instructions).The commission will not host an in-person meeting space. On May 5, 2020, the commission issued a notice inviting comment on its first discussion draft rules. Comments are due by 5 p.m. on June 2, 2020.

On May 26, 2020, the commission issued a notice of joint workshop to be held in cooperation with the Department of Commerce on the subject of incremental cost. The workshop will be held on June 16, 2020, at 9:30 a.m. (AgendaPresentation)

On August 13, 2020, the commission issued a notice providing opportunity to comment on the second draft proposed rules in this docket and docket UE-190698. (Redline RulesClean Rules.) Comments are due by Friday, September 11, 2020.

On August 18, 2020, the commission entered an order consolidating under this docket this rulemaking with the IRP rulemaking in docket UE-190698.

On December 28, 2020, the commission entered General Order R-601, adopting the new rules. It simultaneously filed an emergency rulemaking to repeal WAC 480-100-238.

On January 6, 2021, the commission issued a notice of expedited rulemaking to permanently repeal WAC 480-100-238. The deadline to object to the repeal is March 9, 2021.
