The commission issues a complaint against Washington & Idaho Railway Inc. (WIR) alleging that WIR violated WAC 480-62-300 by failing to pay its annual report for the 2012 and 2013 reporting years, and alleging that WIR violated WAC 480-62-300 by failing to pay its regulatory fee for the 2012 and 2013 reporting year.

Pursuant to RCW 34.05.482 and WAC 480-07-610, the commission determines that a brief adjudicative proceeding is appropriate for determining whether the alleged violations occurred and, if so, the appropriate remedy for those violations.

The commission initially scheduled a  brief adjudicative proceeding in this matter for 9:30 a.m., on July 28, 2015, at commission headquarters in Olympia, Washington.

On July 23, 2015, commission staff notified the commission, by letter, that the parties had reached a settlement in principle.  The commission issued a notice on July 23, suspending the procedural schedule in this matter.  Parties must file either a settlement agreement and supporting documentation or a status report of their negotiations by August 21, 2015.
