On December 8, 2017, the commission assessed a $10,000 penalty against SEFNCO for one violation of RCW 19.122.030(2) for failing to provide the reuired notice to a one-number locator service before excavating. The commmission alleges that SEFNCO excavated outside of the area that had been marked and that SEFNCO's excavation caused damage to the McChord Pipeline. On January 5, 2018, and again on January 23, SEFNCO wrote to the commission contesting the violation and requesting a hearing.
On January 29, 2018, the commission issued a notice of brief adjudicative proceeding. The commission sets time for oral statements on March 21, 2018, at 9:30 a.m., in the commission's hearing room, second floor, Richard Hemstad Building, 1300 S. Evergreen Park Dr. SW, Olympia, Washington.
On April 24, the commission issued a notice suspending procedural schedule and requiring parties to file settlement documents by May 11, 2018.
