Washington Utilities and Transportation Commission
On May 20, 2015, the commission filed with the Code Reviser aPreproposal Statement of Inquiry (CR-101) to consider rules with WAC 480-62 to update railroad annual reporting requirements on financial responsibility and safety standards for private crossings and to provide opportunities for first-class cities to opt in to the commission crossing safety program.
Engrossed Substitute House Bill 1449, Chapter 274, Laws of 2015, adopts financial responsibility reporting requirements that railroads hauling crude oil must include in the annual reports they submit to the commission. In addition, the legislation authorizes the commission to enforce safety standards for private crossings and enables first-class cities to opt in to the commission's rail crossing safety program.
Comments on the CR-101 inquiry and questions listed in the notice must be filed with the commission no later than Monday, June 22, 2015.
In addition to filing written comments, interested persons are invited to attend a stakeholder workshop on Wednesday, July 8, 2015.
On August 21, 2015, the commission issued a notice asking interested persons to file written comments on the draft rules by 5:00 p.m., September 21, 2015, and inviting them to a stakeholder workshop on October 1, 2015, beginning at 9:30 a.m. Due to scheduling conflicts the commission finds it necessary to cancel the workshop. The commission issued a notice on September 28, 2015 cancelling the workshop.
By notice issued November 6, 2015, the commission filed a Notice of Proposed Rulemaking (CR-102) with the Office of the Code Reviser. The commission has prepared proposed rules for review and comment by interested persons. Comments on the proposed rules are due by Monday, December 7, 2015.

On December 28, 2015, the commission issued a notice rescheduling the adoption hearing in this matter.
The new date and time of the adoption hearing on the proposed rules was held at 2:00 p.m., on Thursday, January 7, 2016, at UTC headquarters, Olympia, Washington.
On February 9, 2016, the commission filed its adoption order and rules with the Office of the Code Reviser. Appendix A: comment summary matrix and memo are available by clicking the links. The rules will be effective on March 11, 2016.
