Washington Utilities and Transportation Commission
On April 22, 2014, the commission filed with the Code Reviser a Preproposal Statement of Inquiry (CR-101) to consider adoption of rules to implement RCW ch. 80.54, relating to attachments to transmission facilities.
Federal law requires the Federal Communications Commission (FCC) to regulate attachments to utility poles unless a state certifies that it regulates such attachments. The Washington legislature elected to assert jurisdiction over attachment to transmission facilities by enacting RCW ch. 80.54.
The commission invites initial written comments on rules to implement RCW ch. 80.54. Comments most useful to the commission will be those that address the extent to which it should adopt some or all of the rules promulgated by the OPUC or the FCC governing utility pole and conduit attachments, as well as any suggested rule language. By notice issued April 23, the commission accepted written comments on the CR-101 inquiry until May 30, 2014.
The commission held a stakeholder workshop on Monday, July 28, 2014, at UTC headquarters.
The commission issued a notice on September 8, 2014, inviting interested persons to submit written comments on draft rules by 5:00 p.m., October 8, 2014.
The commission held a second stakeholder workshop on Tuesday, October 28, 2014. In preparation for workshop the agenda and comment summary matrix were available.
On January 6, 2015, the commission issued a notice with revised draft rules for review and comment by interested persons. Comments on the revised draft rules were due with the commission no later than 5:00 p.m., Friday, February 6, 2015. Comments on the revised draft rules are available by clicking here.
On February 10, 2015, the commission issued a notice to all interested persons inviting responses to the comments received on the revised draft rules on February 6, 2015. Responses to the comments were due by February 27, 2015.
On March 24, 2015, the commission issued another notice giving interested persons an opportunity to comment on a third revised draft rules. Comments on the third draft rules were due by April 17, 2015, and reply comments were due by May 1, 2015. The commission prepared a matrix of summarizing the comments from February 6 and 27, 2015, and Staff's recommendations.
On May 27, 2015, the commission issued a notice of opportunity to respond to Small Business Economic Statement (SBEIS) questionnaire. The commission requests that utilities and licensees, as those entities are defined in the draft rules, provide information concerning the cost impact of those rules on your company. The commission requests that affected companies submit to the commission by June 17, 2015, their analysis of whether the draft rules impose a cost impact on the company.
CR-102: On July 22, 2015, the commission filed a Notice of Proposed Rulemaking (CR-102) with the Office of the Code Reviser along with its SBEIS. Written comments on the proposed rules were due by August 24, 2015.
The commission held a public hearing on the adoption of the proposed rules on September 17, 2015, at UTC Headquarters, Olympia, Washington.

On October 21, 2015, the commission filed with the Code Reviser General Order R-582, Order adopting rules permanently. The Commission adopted chapter 480-54 WAC, rules governing attachments to utility transmission facilities. The effective date of the rules will be January 1, 2016.
