Washington Utilities and Transportation Commission
On October 2, 2013, the commission filed with the Office of the Code Reviser a Preproposal Statement of Inquiry (CR-101) to examine with revised regulations are needed to govern the commission's implementation of Initiative Measure No. 937, titled the Energy Independence Act (EIA). Washington voters approved the EIA on November 7, 2006, now codified at chapter 19.285 RCW. The commission adopted EIA rules on November 30, 2007, by General Order R-546 in Docket UE-061895, promulgated as chapter 480-109 WAC. Since adoption of these rules, the Legislature has enacted several amendments to the EIA.
The commission issued a notice to interested persons on October 4 with a number of questions it would like to receive comments on. Written comments on the CR-101 inquiry and the questions listed in the notice were due, Monday, December 2, 2013.

On April 9, 2014, the commission issued a notice with informal draft rules. A clean and redlined version of the draft rules are available. comments on the draft rules and the questions listed in the notice were due no later than 5:00 p.m., Friday, May 9, 2014.
Pursuant to the April 9 notice, a memo from an Assistant Attorney General interpreting the requirement that utilities pursue all cost-effective conservation under RCW 19.285.040(1) is available by clicking the link.
The commission held a 2nd stakeholder workshop on May 15, 2014, at 9:30 a.m., at UTC headquarters in Olympia, Washington.
On September 3, 2014, the commission filed a Notice of Proposed Rulemaking (CR-102) with the Office of the Code Reviser. Comments on the proposed rules were due no later than October 6, 2014. You may click here to review a summary of comments received.
The commission held a public adoption hearing on the proposed rule on Wednesday, November 5, 2014. The public hearing was held in the commission's hearing room, second floor, Richard Hemstad Building, 1300 S. Evergreen Park Drive S.W., Olympia, Washington. On March 12, 2015, the commission filed its Adoption Order with the Code Reviser. These rules will be effective on the 31st day following that filing. The commission served a letter regarding the filing of the adoption order on March 13. That letter is available by clicking here.
Also, on March 12, 2015, the commission concurrently filed a Proposed Rulemaking (CR-102) continuance of WSR 14-18-084 to temporarily defer adoption of WAC 480-109-300, a reporting requirement for energy and emissions intensity metrics.
