Washington Utilities and Transportation Commission
On June 5, 2012, the City of Auburn (City) filed with the commission a petition to construct a highway-rail grade crossing at A Street Northwest, City of Auburn.
On June 26, 2012, BNSF Railway Company (BNSF) notified the commission that it had some objections to the petition that might be resolved if the City was willing to revise their petition and agreeable to installing active warning devices with all construction and future maintenance-related costs allocated to the City. The City and BNSF have not come to agreement on these issues.
The commission held a prehearing conference in this matter on August 22, 2012, in Olympia, Washington. At the prehearing conference the parties agreed on a procedural schedule, see Order 01, Prehearing Conference Order for more information.
On November 1, 2012, the City of Auburn filed a letter with the commission notifying the commission that the parties had reached a full settlement in principle in this matter.
The commission issued a notice on that same day suspending the procedural schedule. The commission also gave notice that the parties must file a settlement agreement and supporting narratives by November 16, 2012.
On November 16, 2012, the City of Auburn filed a Motion to Withdraw Petition. On November 27, 2012, the commission issued an initial order granting the motion to withdraw petition.
