On March 13, 2017, commission staff notified Buckley Senior Citizens, Inc. that staff was proposing an "unsatisfactory" safety rating for Buckley Senior Citizens, based on the results of a January 2017 compliance review. Federal law incorporated into WAC 480-31-130 prohibits motor carriers transporting passengers in a commercial motor vehicle from operating beginning on the 46th day after the date of the notice of a proposed unsatisfactory rating. Buckley Senior Citizens must come into compliance by obtaining commission approval of a safety management plan no later than Thursday, April 27, 2017.
On March 16, 2017, the commission issued a notice informing Buckley Senior Citiznes that the commission will hold a brief adjudicative hearing in this matter on Wednesday, April 19, 2017, at 9:30 a.m., in the commission's hearing room, second floor, Richard Hemstad Building, 1300 S. Evergreen Park Drive, S.W., Olympia, Washington.
On April 21, 2017, the commission entered it's Initial Order, upgrading the safety rating and suspending part of the penalties imposed. Absent a request for administrative review, this order will become final on May 11, 2017.
