On March 10, 2014, BNSF Railway Company (BNSF) filed with the commission a Petition for the closure of the N. Stevens highway-rail grade crossing near the City of Toppenish, Yakima County (Docket TR-140382), and a Petition for the closure of the Barnhart highway-rail grade crossing near the City of Mabton, Yakima County (Docket TR-140383).
On March 27, 2014, Yakima County filed an objection to the petitions and a request that the matters be scheduled for hearing.
On April 21, 2014, the Yakama Nation Tribal Council and the Washington Farm Bureau also filed letters objecting to the closure of the rail crossings.
The commission held a prehearing conference in these matters on May 23, 2014, and issues a prehearing conference order on May 27, 2014.
On October 28, 2014, the commission issued a notice suspending the procedural schedule and scheduling a telephonic prehearing conference for November 4, 2014, at 2:30 p.m..
The commission entered Order 02 in these dockets on November 6, 2014. The order sets the procedural schedule in this matter as well as an evidentiary and public comment hearing. The evidentiary hearing will be held on Tuesday, April 28, 2015, at 9:30 a.m., with the public comment hearing being held at 6:00 p.m. on April 28, 2014 as well.
On March 11, 2015, the commission issued a notice chaning the location of the hearings. Both the evidentiary and public comment hearing will now take place at the Yakima County Resource Center, 2403 S. 18th St., Union Gap, WA.
On August 18, 2015, the commission entered Order 03 - Initial Order Denying Petitions.
