On February 8, 2017, the commission entered Order 01, a complaint and notice of brief adjudicative proceeding in the special proceeding instigated against Ghostruck, Inc.for violations of RCW 81.80.075 based on commission staff's investigation (Report & Appendices). Commission staff alleges that Ghostruck, Inc. has been operating as a household goods carrier in the state of Washington without a permit from the commission.
Order 01 set this matter for hearing at 1:30 p.m., on March 9, 2017. On March 7, 2017, the commission issued a notice amending the procedural schedule. The hearing was set for 9:30 a.m., March 22, 2017. On March 21, 2017, the commission issued a notice suspending the procedural schedule, which cancelled the hearing. The notice also set a deadline of March 24, 2017, for Ghostruck to renew their request for recusal.
On March 27, 2017, the commission issued a notice of recusal for Judge Pearson. Also on March 27, the commission issued a notice of substitution of presiding officer and notice of hearing. The hearing was held on April 5, 2017, at 9:30 a.m. in the commission's hearing room, second floor, Richard Hemstad Building, 1300 S. Evergreen Park Dr. SW, Olympia, Washington.
on April 25, 2017, the commission entered it's Initial Order, which classified the respondent as a Household Goods Carrier, ordered Ghostruck to cease and desist, and imposed and suspended penalties on condition of future compliance. This order will become final on May 15, 2017.
