City of Spokane v. Union Pacific RR, Docket TR-111033

On August 30, 2011, the commission held a prehearing conference on a petition filed by the City of Spokane Valley to modify warning devices and install sidewalks at a highway-rail grade crossing at Pines Rd. (SR-27), Spokane County, USDOT Crossing Number 662519S.

The commission entered its Order 01 - Prehearing Conference Order establishing a procedural schedule in this matter.

On November 3, 2011, the commission entered Order 02, an order granting the request to modify the procedural schedule, which, among other things, rescheduled the evidentiary hearing from March 28, 2011, to May 2, 2012, beginning at 10:00 a.m. at the Commission's headquarters.

On December 21, 2011, the commission entered Order 03, an order granting motion for continuance and to modify the procedural schedule and reschedule the May 2, 2012 hearing to June 13, 2012, beginning at 10:00 a.m. at the commission's headquarters.

On February 7, 2012, the commission entered Order 04, an order granting amended motion for continuance and rescheduling the hearing previously scheduled for June 13, 2012, to August 8, 2012.  

On April 2, 2012, the City of Spokane Valley filed a motion to withdraw its petition and asserts that it has reached a settlement with the Railroad which resolves the cost allocation issues for the installations.

The commission issued Order 05 on April 3, initial order granting the motion to withdraw petition, without prejudice, and vacating the procedural schedule.​
