White Pages Directory Rulemaking, UT-120451

​On April 18, 2012, the commission filed with the Code Reviser a Preproposal Statement of Inquiry (CR-101) to consider modification to, or elimination of, the requirement that local exchange companies provide each customer a copy of a telephone directory for the customer's exchange area, as described in WAC 480-120-251.

Interested persons were asked to comment on whether the commission should eliminate or modify the current requirement that telecommunications companies provide printed directories.  A list of questions the commission would find comments useful are available in the notice by clicking here.

The commission received written comments on the CR-101 and the questions listed in the notice by the deadline of  May 21, 2012.

The commission developed proposed rule revisions with the benefit of stakeholder comments.  On July 18, 2012 the commission filed a Notice of Proposed Rulemaking (CR-102) with the Code Reviser in this docket.  The commission invites written comments on the proposed rule to the commission by Monday, August 20, 2012. 

The commission filed a CR-102 continuance with the Code Reviser on August 24, 2012.  The commission finds it necessary to reschedule the adoption hearing from Wednesday, September 12, 2012, to 9:30 a.m., Thursday, October 18, 2012.  The commission issued a notice to all interested persons of this reschedule on August 27, 2012.

On September 14, 2012, the commission issued a notice of an opportunity to respond to comments received on the CR-102.  The commission is also seeking additional information in support of the positions that interested persons have taken in this docket.  Responses to initial CR-102 comments filed on the proposed rule and additional empirical evidence in support of, or opposition to, any proposed changes to the existing or proposed rule are due no later than September 25, 2012.  All comments are available by clicking here.

A public hearing was rescheduled from September 12 to October 18, 2012, 9:30 a.m.  NOTE:  By notice issued October 12, that time will now be used to conduct a workshop to discuss how best to revise local exchange companies' current obligations to distribute white pages directories to their customers.  A list of questions that workshop participants should be prepared to address are listed in the notice.  A copy of the Dex One PowerPoint presentation that will be presented at the workshop is available by clicking here.  The workshop will be held in the commission's hearing room, second floor, Richard Hemstad Building, 1300 S. Evergreen Park Drive S.W., Olympia, Washington. 

The commission has considered the comments and the workshop discussion and has prepared a revised proposed directory listings rule.  Comments on the proposed revised rule were on November 14, 2012.  A comment summary matrix of the November 14 comments is available.

The commission has filed with the Code Reviser a Supplemental CR-102.  The Supplemental CR-102 proposal amends WAC 480-120-251 so that carriers have the flexibility to comply with their obligation to make basic directory listings available to their local exchange customers either by providing those customers with access to electronic listings and making printed directories available to customers who request them, or by distributing printed directories to all customers except those who request not to receive them.  Comments on the Supplemental CR-102 were due by January 22, 2013.  Please click the appropriate link to view the Notice, CR-102, and/or proposed rule for comment.  The Commission held an adoption hearing on the Supplemental CR-102 and heard oral comments from interested persons on February 14, 2013.

The commission filed a second Supplemental CR-102 with the Code Reviser on February 27, 2013.  The commission issued a notice to all interested persons on March 1, 2013.  This Supplemental CR-102 amends the proposal so that carriers are obligated only to provide electronic access to directory listings and must provide printed directories only to customers who request them.  If carriers also distribute printed directories to customers who do no request them, the rule would require that carriers not distribute a printed directory to customers who request not to receive them.  Comments on the second Supplemental CR-102 rule were due by March 29, 2013.

A public hearing about the proposal for the adoption of the second supplemental proposed rule was held on Thursday, April 11, 2013, at 1:30 p.m. at UTC headquarters in Olympia, Washington.

Adoption Order

The commission filed an adoption order with the Code Reviser on April 16, 2013.  Appendix A, Comment Summary Matrix, and Appendix B, WAC 480-120-451 are available by clicking on the appropriate link.  The rule will become effective on May 17, 2013.
